MiCA comes fully into force: MiCA register was published

The EU's Markets in Crypto-Assets Regulation (MiCA) came into full effect on 30 December 2024, following its initial entry into force on 29 June 2023. MiCA establishes the EU as the first major jurisdiction to regulate crypto-assets comprehensively. It creates a harmonized framework for crypto-asset issuance and services, covering various types of crypto-assets such as asset-referenced tokens (ARTs), electronic-money tokens (EMTs) and other crypto-assets (this blanket category covers utility tokens and other crypto-assets that don't qualify as ARTs or EMTs). This regulation also introduces a pan-European licensing and supervisory system for issuers, platforms, and crypto-asset service providers (CASPs). Notably, Titles III and IV, dealing with ARTs and EMTs, were applied from 30 June 2024.

 

As of 30 December 2024, the European Securities and Markets Authority (ESMA) is empowered under Articles 109 and 110 of the MiCA Regulation to maintain and publish a central register of crypto-asset white papers, authorized crypto-asset service providers (CASPs), and non-compliant entities. This register will be sourced from the relevant National Competent Authorities (NCAs) and the European Banking Authority (EBA).

 

To meet the legal deadline, ESMA has created an interim MiCA register, which will be updated and republished regularly. This interim register, accessible on the MiCA webpage and the Databases and Registers page, will be available as a collection of CSV files until mid-2026, when it will be formally integrated into ESMA’s IT systems. The interim register includes five CSV files, which cover:

 

·      Issuers of asset-referenced tokens (Title III)

·      Issuers of e-money tokens (Title IV)

 

Although four of the five files in the interim MiCA register are currently empty, the file related to issuers of EMTs contains crucial information. As of January 06, 2025, this file lists companies that have obtained authorization to issue e-money tokens under MiCA. Companies like:

  • Membrane Finance Oy;

  • Circle Internet Financial Europe SAS;

  • Société Générale – Forge;

  • Banking Circle S.A.;

  • Quantoz Payments B.V. and

  • Fiat Republic Netherlands B.V.

are included in this file, showcasing their official approval status and providing access to their relevant white papers, authorization dates, and other key details.

 

ESMA will update the register on a monthly basis, and while information will be reported by competent authorities on a rolling basis, it will not appear in the register immediately. Records in the interim MiCA register will reflect the information provided by the relevant authorities. If an authorization is withdrawn by a competent authority, the record will remain in the register, noting the date when the withdrawal took effect.

 

With the establishment of the interim MiCA register and its regular updates, the European Union continues to lead the way in creating a transparent and compliant digital finance environment.
